Notice of entry - Rules for entry involving VCAT

Rules of entry due to VCAT proceedings with the rental agreement.

As per the VCAT order, the rental provider or their agent may conduct an inspection of the property to assess its condition, as the rental agreement has been directed to change due to family violence. However, the rental provider is obligated to provide the renter with a minimum of 24 hours' notice before entering the premises for this purpose.

In cases where a renter has been excluded from the property due to family violence, they have the option of nominating a representative to attend the inspection on their behalf. The renter must provide the contact details and name of the representative beforehand, which should be included in the notice of entry issued to the remaining renter residing in the property.

Damages during entry.

If something belonging to the renter is damaged or taken while the rental provider or their agent is on the property, the renter may apply to VCAT to be compensated for their loss.
